Medical records contains significant information regarding relevant clinical findings, decisions made and actions agreed upon, and about those making and agreeing to those decisions. For medical litigations, these records serve as key evidence. Medical chart review is also crucial to extract the medical evidence from the records. Attorneys and law firms handling medical records need to ensure the privacy and confidentiality of these records, when using them to develop their case. Once all the medical records are collected, they have to be reviewed. Most attorneys prefer utilizing professional medical review services for a comprehensive review process.

Why medical records are necessary in a legal proceeding?

Medical records support trial preparation in the following ways –

  • They provide clear information regarding the plaintiff’s injury, extent and nature
  • They help determine the cause of the injury
  • They help find out whether reasonable care is provided
  • To estimate the damages sustained by the injured person, and
  • To help prove whether that injury contributed to the disability
